Accessing and Correcting Your Information

You may also send us an email at privacy@libertyhealthshare.org to request access to, correct or delete any Personal Information that you have provided to us. If we cannot delete your Personal Information except by also deleting your user account, you understand that we will delete your user account. We may not accommodate a request to change or delete information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.

HIPAA Business Associate Privacy Policy

Definitions:

  • Covered Entity” means a health plan, healthcare provider, healthcare clearinghouse, or any authorized entity representative that must comply with the HIPAA Privacy or Security Rules.
  • Business Associate” means a person or entity who performs functions or activities for, or provides services on behalf of, a Covered Entity that involve the use or disclosure of PHI.
  • Business Associate Agreement” means a formal written agreement between us and our Covered Entity customers, and/or between us and our Business Associate subcontractors, that requires us and our Business Associate subcontractors to comply with specific protections afforded to the security and privacy of PHI under HIPAA.
  • Service Agreement” means an underlying agreement between us and a Covered Entity to which a Business Associate Agreement applies.

While we are not a Covered Entity, we may work with Covered Entities regulated under the Health Insurance Information Portability and Accountability Act (“HIPAA”) of 1996, as amended, including without limitation the Health Information Technology for Economic and Clinical Health (“HITECH”) Act of 2009 (collectively referred to herein as “HIPAA”). In the process of working with these Covered Entities we may access, receive, process, maintain, archive, and/or transmit information defined by HIPAA as Protected Health Information (“PHI”) and/or Electronic Protected Health Information (“ePHI”) from such Covered Entities (PHI and ePHI are collectively referred to herein as “PHI”). In some situations, we may be considered a Business Associate of a Covered Entity regulated by HIPAA.

We share a commitment with any Covered Entity to protect the security and privacy of all PHI that we obtain. Therefore, the following applies to our practices regarding PHI.


Use and Disclosure of PHI

Provided that such use or disclosure does not violate the applicable Service Agreement, Business Associate Agreement or the HIPAA privacy or security rules as applicable to us, we may:

  • use or disclose PHI on behalf of, or to provide services to, Covered Entities for purposes of performing our obligations owed to such Covered Entity;
  • use PHI internally for our own internal management, administration, data aggregation and legal obligations;
  • disclose PHI to downstream subcontractors or agents that provide supporting services to us, provided that, to the extent required by HIPAA, all such subcontractors and agents will be required to enter into a Business Associate Agreement with us and to comply with the same terms and conditions that apply to our use and disclosure of PHI, including the implementation and maintenance of required HIPAA privacy and security safeguards; and
  • disclose PHI for law enforcement purposes, or in response to subpoenas as required by law, and for other national priority purposes when an authorization or opportunity to object is not required by HIPAA.

Safeguards

We have established and maintain appropriate safeguards to prevent the use or disclosure of PHI other than as provided for by our Services Agreements, Business Associate Agreements and HIPAA. These safeguards include administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity and availability of the PHI that we access, receive, process, maintain and/or transmit on behalf of appliable Covered Entities.

Examples of such safeguards include but are not limited to:

  • Maintaining appropriate clearance procedures and providing supervision to assure that our workforce follows appropriate security procedures;
  • Providing appropriate training to our staff to ensure that our staff complies with our privacy and security policies;
  • Making appropriate use of encryption when transmitting PHI over the internet;
  • Utilizing appropriate storage, backup, disposal and reuse procedures to protect PHI;
  • Utilizing appropriate authentication and access controls to safeguard PHI;
  • Utilizing appropriate security incident procedures and providing training to our staff sufficient to detect and analyze security incidents; and
  • Maintaining a current contingency plan and emergency access plan in case of emergency to assure that the PHI we hold on behalf of a Covered Entity is available when needed.

Mitigation of Harm

In the event of a use or disclosure of PHI that is in violation of the requirements of a Business Associate Agreement, we will mitigate, to the extent practicable, any known, harmful effect resulting from the violation.

Such mitigation will include:

  • Reporting any use or disclosure of PHI not provided for by the Business Associate Agreement, and any security incident that we become aware of, to the Covered Entity; and
  • Documenting such disclosures of PHI and information related to such disclosures as would be required for a Covered Entity to respond to a request for an accounting of disclosures of PHI in accordance with HIPAA.

Access to PHI

To the extent required by the applicable Service Agreement, Business Associate Agreement, and HIPAA, we will:

  • make available to a Covered Entity that information necessary for the Covered Entity to provide individuals with their rights of access, amendment, and accounting of disclosures in accordance with HIPAA; and
  • upon request from such Covered Entity, make our internal practices, books and records including policies and procedures relating to the use and disclosure of PHI received from, created by, or received by a Business Associate on behalf of the Covered Entity available to the Covered Entity or the Secretary of the U.S. Department of Health and Human Services for the purposes of determining compliance with the terms of the Business Associate Agreement and HIPAA regulations.

Conflict with Other Provisions of Our Privacy Policy

To the extent that any of the above HIPAA provisions of our Privacy Policy conflict with the remainder of this Policy, the HIPAA provisions prevail with respect to any Covered Entity and our downstream Business Associate subcontractors.


Your State Privacy Rights

In addition to the other rights provided in our Privacy Policy, the following sections describe the additional rights available to residents of certain states.


California

This section applies solely to visitors, users, and others who reside in California. We adopt this section to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended, and any terms defined in the CCPA have the same meaning when used in this section.

This section does not apply to workforce-related Personal Information collected from California-based employees, job applicants, contractors, or similar individuals.

Your Choices Regarding Our Use of Your Personal Information


Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months (the “right to know”). You may only submit a request to know twice within a 12-month period. Once we receive your request and confirm your identity (see Exercising Your Rights), we will disclose to you:

  • Our business or commercial purpose for collecting or selling that Personal Information.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights

To exercise any of these rights described above, please submit a request by:

Only you, or someone legally authorized to act on your behalf, may exercise any of these rights related to your Personal Information. You may make a request to exercise any of these rights on behalf of your child. Your request to exercise any of these rights must:

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, which may include:
    • If you are submitting a request to know categories of personal information or to delete non-sensitive information with a low risk of harm: (i) you must provide at least two pieces of personal information which match information we already hold; and (ii) we must determine that the information matched is reliable for verification purposes.
    • If you are submitting a request to know specific pieces of personal information or to delete sensitive information with a high risk of harm: (i) you must provide at least three pieces of personal information which match information we already hold; and (ii) we must determine that the information matched is reliable for verification purposes.
    • If you are submitting a request as someone legally authorized to submit such request on behalf of another, we may require you to provide proof of a valid power of attorney under California’s Probate Code, or one of more of the following: (i) proof of the other person’s signed permission to submit the request; (ii) the other person verifying their identity directly with us, or (iii) the other person directly confirms that they have authorized you to submit the request on their behalf.
    • If you are making a request to exercise any of these rights on behalf of your child, we will require one of the following: (i) signing and returning a consent form to us; (ii) using a toll-free telephone number, video conference, or otherwise communicating in person with our trained personnel; or (iii) producing a form of government-issued identification to compare against databases of that information.
    • We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
    • You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.
    • We will only use the Personal Information provided in the request to verify the requestor's identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us by emailing us at privacy@libertyhealthshare.org or calling us at 855-585-4237.

We endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.


Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Liberty HealthShare is committed to respecting the privacy of our donors. This Donor Privacy Policy applies to all information received by Liberty HealthShare both online and offline and through any giving platform (“platform” includes the Liberty HealthShare website, ShareBox, social media outlets, and mobile applications), as well as any electronic, written, or oral communications.

Information Collected

Here are the types of donor information that we collect and maintain:

  • contact information: name, organization/company, complete address, phone number, email address
  • donation information: amounts donated, date of donation(s), method and stimulus
  • your requests and comments
  • information gathered from database modeling firms
  • non-personally identifiable information, such as how many hits each Liberty HealthShare website page receives, and if the visitor is repeat or new. This requires that a ‘cookie’ be sent to your web browser.

How Information is Used

Liberty HealthShare uses your data to maintain records of donations, send acknowledgements, mail tax statements to you, send newsletters, notices and direct mail pieces, and for internal marketing purposes. If you use a credit or debit card, we may use card authorization and fraud-screening services to verify that your card information and address match the information you supplied to us and that the card being used has not been reported lost or stolen.

No Sharing of Personal Information

Liberty HealthShare will not sell, rent, trade or transfer your personal information to outside organizations. Use of donor information will be limited to the internal purposes of Liberty HealthShare and only to further the mission of Liberty HealthShare.
